  • 1 GENERAL RULES
  1. The organizer of the competition under the name "We in your home and garden" (hereinafter referred to as the Competition) is Admit sp. Z o.o. sp.k. ul. Stary Dwór 16, 43-436 Górki Wielkie, entered into the Register of Entrepreneurs of the National Court Register under the KRS number: 00000736727, NIP: 5481398489, REGON: 070729502, (hereinafter referred to as the Admit company).
  1. The awards in the competition are provided by the Admit company.
  1. Admit declares that the Competition is in no way sponsored, supported, administered or created in cooperation with the Facebook® Website. Any questions, comments, complaints and complaints related to the Competition should be directed to the Organizer, and in no case to the owner or administrator of the Facebook® Website. All personal data and information provided by participants as part of the Competition are entrusted to Admit, and not to the owner or administrator of the Facebook® Website. Admit releases Facebook in its entirety from any liability to Participants resulting from the Competition.
  1. The Admit company declares that the Competition is not a raffle lottery, a mutual bet, a promotional lottery, the result of which depends on the case, or any other game of chance provided for in the Gambling Act of 19 November 2009 (i.e. Journal of Laws No. of 2015, item 612).
  • 2 DEFINITIONS
  1. Participant - a person who meets the conditions set out in §5 of the Regulations.
  2. "We in your home and garden" - Contest on Instagram and Facebook
  3. Instagram - a social networking site where registered users can create networks and groups, share messages and photos owned by Facebook, Inc.
  4. Facebook - a social network where registered users can create networks and groups, share messages and photos owned by Facebook, Inc.
  5. User - a natural person who, after undergoing the registration procedure, has access to the services offered on the Instagram and Facebook social networking sites.
  6. Profile - one of the basic functions of Instagram and Facebook, a new type of user or brand profile that allows you to add photos and posts directed to people who like a given profile. The said profiles of Admit sp.z o.o. sp.k are available at: https://www.instagram.com/admit_swiece_znicze/ and https://www.facebook.com/admitpolska
  7. Competition Post - a post placed on Profiles belonging to Admit sp.z o.o. sp.k. containing a Competition Task.
  8. Competition task - consists in sending by the User a photo of his own authorship, which shows the product purchased from Admit sp.z o.o. sp.k.
  9. Competition Application - an exclusive photo of the Participant, provided by the Participant via Instagram and Facebook, containing the performance of the Competition Task; the work must be in the form of a photo. Only Competition Posts may be submitted to the Competition:
  10. a) related to the subject of the Competition,
  11. b) for which the Participant has full copyrights,
  12. c) for which the Participant has consents to publish the image of the people presented in the photo.
  13. Competition Commission - three persons appointed by Admit (from among employees) responsible for selecting the winners of a given edition of the Competition from among the Participants.
  • 3 REGULATIONS
  1. The regulations of the "We in your home and garden" competition (hereinafter referred to as the Regulations) define the rules

and conditions for participation in this Competition.

  1. The condition for participation in the Competition is the Participant's prior reading of the Regulations and its acceptance and consent to the processing of personal data, to the extent specified in these Regulations.
  2. In justified cases, Admit reserves the right to change the provisions of these Regulations at any time by posting the changed, uniform text of the Regulations on the website.
  3. Admit reserves the right to cancel the Contest without giving any reason.
  4. The content of these Regulations will be made available to all potential Competition Participants on the website www.admit.pl.
  • 4 DURATION OF THE COMPETITION
  1. The competition takes place on the Facebook profiles of Admit sp.z o.o sp.k and Instagram Admit sp.z o.o. sp.k. from May 5 to May 31, 2021 (hereinafter the "Contest Period"). The time of the Application is determined by the moment of registering the application on any Admit company profile.
  2. 5 people win the competition, the selected winner will be announced by 05/06/2021 on the Admit sp.z o.o sp.k. profile. (Facebook and Instagram).
  3. The period of the Competition does not include the issue of prizes and the complaint procedure.
  • 5 PARTICIPATION CONDITIONS
  1. To participate in the Competition, the following conditions must be met:
  2. a) be an adult natural person with full legal capacity;
  3. b) have the status of a User of Instagram and Facebook;
  4. c) publish at least one Competition Application.
  5. Each Competition Participant is required to read the Regulations before entering it. Acceptance of the Regulations is a condition of participation in the Competition.
  6. Participants of the Competition may not be employees and associates of the Admit company, as well as persons who are their spouses, ascendants, descendants, siblings, relatives in a straight line, as well as persons living together with these employees and associates.
  7. Participation in the Competition is completely voluntary.
  • 6 RULES AND COURSE OF THE COMPETITION
  1. The Admit company conducts the Competition in person.
  2. In order to take part in the Competition, the Participant should submit a Competition Application, i.e. send a photo to the organizer, of his own authorship on Instagram or Facebook, containing the performance of the Competition Task; the work must be in the form of a photo.
  3. Competition applications may be published no later than May 31, 2021, 23:59 (hereinafter "Application").
  4. The Competition task consists in sending by the User a photo of his own authorship showing how he uses the items of the Admit company.
  5. The Competition Application may only take the form specified in the content of the Competition Task.
  6. Competition Entries may not contain vulgar, offensive, indecent, discriminatory, offensive to religious feelings or otherwise contrary to the law or principles of social coexistence, or contain proprietary names or signs other than the names and marks of Admit Sp. z o.o. sp.k. Competition entries may not infringe the rights, in particular copyrights, and personal rights of third parties.
  7. By posting the Contest Application, the Participant ensures that he is the author of the Contest Application posted and has unlimited personal and property copyrights to the Contest Application posted.
  8. Competition Entries that do not meet the requirements set out in points 2–6 of the Regulations will be removed by Admit and will not be included in the Competition, and their authors will not be eligible to apply for the Prizes.
  9. The prizes in the Competition are not cumulative, which means that one Competition Participant may receive only one Prize, regardless of the number of Competition Applications submitted.
  10. Participation in the Competition is tantamount to the acceptance of the Competition Regulations and the Participant's consent to the transfer of the proprietary copyrights of the photo submitted to the Competition to the Organizer and its publication. The Competition Commission (hereinafter referred to as the "Committee") will evaluate the entries, taking into account in particular their originality and attractiveness, guided by a subjective opinion, and will select 3 winning entries, which will be awarded the Main Prize (hereinafter the "Prize"). 11. The winners will be selected by June 5, 2021, in accordance with point 2 §4 of the Regulations and informed by that date.
  11. The Contest Participant acquires the right to the prize if he contacts Admit via a private message on Instagram or Facebook within 5 working days from the date of announcing the winners by the Organizer in accordance with the Regulations. In response to the message, the winner will be asked to provide the following data: name and surname, e-mail address, telephone number in a private message within the next 2 working days from the date of receipt of the message on Instagram.com or Facebook.com. Sending the above-mentioned data is necessary to receive the prize. Failure to contact and submit data within the above-mentioned deadlines shall mean resignation from the prize and the Organizer will award the prize to another Participant selected by the Competition Committee.
  12. The Participant is not entitled to demand that the Prize be exchanged for a cash prize, or for another prize, or the rights to the prize be transferred to another person.
  13. The Competition Winners are not subject to the obligation to pay 10% personal income tax on the Prizes won.
  • 7 AWARDS

1. The prizes in the competition are five sets of Admit products worth PLN 50

(in words: fifty zlotys).

  1. A participant may only win one prize.
  2. The Competition Committee will evaluate the applications, taking into account in particular their originality and attractiveness, guided by a subjective opinion. On this basis, the Competition Commission will select 5 Winners.
  3. The prize is collected by the Winner in person at the Admit Sales Office during office hours, i.e. from Monday to Friday from 8.00 to 16.00, or it will be sent to the postal address indicated by the Participant.
  • 8 COMPETITION COMMISSION
  1. In order to ensure the proper organization and conduct of the Competition, and in particular to assess the correctness of applications to the Competition, select the participants and select the Competition Winners, the Admit company will appoint a Commission. The Committee will be composed of 3 persons indicated by Admit.
  • 9 RIGHTS AND DUTIES OF THE ORGANIZER
  1. Admit reserves the right to exclude from the Competition Participants whose actions are against the law, decency or the Competition Regulations, in particular Participants who:

1.1. they do not act in person, but through third parties;

1.2. post indecent content or violate the rights of third parties, use profanity, use content that offends national or sexual minorities, as well as religious, indecent or otherwise inappropriate beliefs.

1.3. they publish their competition entry from fictitious accounts.

  1. In order to clarify doubts related to the Participant's activity in the Competition, Admit may contact the Participant through the means of communication indicated by him (e.g. conduct e-mail correspondence); during such contact, Admit may expect the Participant to provide detailed information regarding his participation in the Competition.
  • 10 COMPLAINTS
  1. Complaints regarding the Competition will be accepted within 7 days from the date of announcement of the results, to the following address: biuro@admit.pl
  2. Complaints will be considered within 14 working days from the date of delivery of the complaint.
  3. Competition participants submitting a complaint will be notified of the method of its resolution within 3 days from the date of considering the complaint by the Committee. The decision of the Commission is final.
  • 11 PERSONAL DATA
  1. Personal data provided by Competition Participants in connection with the application for participation in the Competition are processed on the basis and in accordance with the provisions of the GDPR and other provisions on the protection of personal data.
  2. The publication of the Competition Application is tantamount to the Competition Participant's consent to the processing of his personal data for the purposes of organizing the competition. By expressing consent, the Participant has the right to withdraw it at any time, sending information about its withdrawal to the address of the Admit company.
  3. Withdrawal of consent does not affect the lawfulness of the processing which was carried out on the basis of consent before its withdrawal.
  4. The administrator of the personal data of the Competition Participants is Admit sp.z o.o. sp.k. with headquarters in Górki Wielkie, ul. Stary Dwór 16. In matters related to the protection of personal data, you can contact the Administrator at the following e-mail address: pbi@admit.pladmit.pl
  5. The administrator, in connection with the Competition, will process the following data: name of the profile / account on Instagram and / or Facebook and the image, and in the case of winners also: name and surname, e-mail address, telephone number.
  6. Providing data is voluntary, but necessary to the extent related to participation in the Competition.
  7. The legal basis for the processing of the Participants' personal data is their consent, expressed by submitting the Competition Application - art. 6 sec. 1 letter a) of the GDPR, as well as the necessity to implement the legitimate interest of the Administrator, which is direct marketing and investigation / defense against claims - art. 6 sec. 1 lit. f) GDPR.
  8. Participants' personal data will be processed for the duration of the competition and up to 21 days after it is resolved, and in the event of a complaint - until it is handled. The winners' personal data will be processed during the period of limitation of claims related to participation in the competition. In the field of image, the Participants' personal data will be processed until the consent is withdrawn.
  9. The recipients of personal data will be employees and associates of the Administrator, as well as companies acting on the Administrator's request and providing services in the field of IT, archiving and destruction of documentation, as well as supporting marketing processes.
  10. Personal data will not be used for profiling, including for making automated decisions.
  1. Competition participants have the right to:
  • request access to your personal data, rectification, deletion or limitation of processing, as well as the right to transfer data,
  • withdraw consent to data processing at any time; it does not affect the lawfulness of the processing which was carried out on the basis of consent before its withdrawal,
  • object at any time to the processing of personal data for reasons related to the particular situation of the Participant,
  • file a complaint to the President of the Personal Data Protection Office.

  • 12 INTELLECTUAL PROPERTY RIGHTS TO COMPETITION SUBMISSION
  1. The Participant declares that he is entitled to the exclusive and unlimited copyrights (property) to the Contest Application. The Participant ensures that the Competition Application is not burdened with any legal or physical defects, claims and other rights of third parties. In the event that any of the above statements of the Participant turns out to be false, the Participant undertakes to bear all the consequences resulting therefrom, including in particular the obligation to release Admit from any claims of third parties for infringement of their copyrights or other rights by the Participant's Contest Application. .
  2. By submitting the Competition Entry, the Participant grants Admit a free, non-exclusive license to use the content of the Application (in whole or in any part) on the territory of Poland and around the world, for an initial period of 5 years, and after 5 years the contract will be converted into a one-time agreement. indefinite, and the Participant will have the right to terminate the license granted for an indefinite period with a 2-year notice period, with the right to sub-license, in all currently known fields of use, in particular to:

recording, reproduction and publication of the work on the Internet, mobile telephony or other electronic media (including social networks such as Facebook, Instagram) and non-electronic media, the third to exercise derivative copyrights to respond to the Competition Task.

  1. The Admit company reserves that as soon as the Winner receives the prize, it acquires the ownership of the Competition Application and the proprietary copyrights to the Competition Application, as well as the consent and authorizations referred to in this § 9 pursuant to art. 921 § 3 of the Civil Code, without quantitative, temporal and territorial limitations in all fields of exploitation. Acquisition of rights pursuant to Art. 921 § 3 of the Civil Code does not infringe the license granted in accordance with § 9 para. 1 of the Regulations. In particular, the transfer of proprietary copyrights to the Competition Application covers the following fields of use:
  2. a) recording and reproducing the work - public sharing in such a way that everyone can have access to it at a place and time chosen by them, publishing a photo on the Internet, mobile telephony or other electronic media (including social networks such as Facebook, Instagram) and non-electronic,
  3. b) repeatedly entering into the memory of a computer, computer network, in particular the Internet, to databases, as well as to the memory of all other types of electronic devices,
  4. c) multiple entries to multimedia networks,
  5. d) operation on the Internet, on websites, social networks, such as Facebook, Instagram, for a fee or free of charge, on request, via telephone or satellite, wired or wireless lines, digital or analog techniques,
  6. Admit is not required to use the Contest Application in any of the fields of use listed above.
  7. The Participant declares that he has read the purpose specified in these Regulations for which the awarded Competition Entries will be used and that he agrees to such use of the Competition Entry by Admit.
  8. The Winner agrees and declares that his / her right is not infringed by combining the Contest Entry with other works or works not having the character of the Contest Entry, removing parts of the Contest Entry or adding new elements to them, as well as placing the Contest Entry next to or adjacent to other Contest Entries.
  • 13 PERMISSION TO DISSEMINATE IMAGE
  1. The publication of the Competition Application is tantamount to the express consent of the Competition Participant within the meaning of Art. 81 of the Act of February 4, 1994 on copyright and related rights (Journal of Laws of 2018, item 1191, as amended) for the distribution of the image by Admit on the terms and in the manner specified in paragraph 2.
  2. The Admit company is entitled to disseminate the image for informational and promotional purposes by making the image available without time and territorial restrictions, in particular for the purpose of posting the image in external media and in the internal media of the Organizer. In order to enable the dissemination of the image, the Organizer is entitled to make changes and modifications to the Competition Application, consisting in its graphic processing (retouching, changing framing and other similar modifications) and incorporating the image into other works, including articles, provided that these changes and modifications cannot distort the Image.
  3. Granting the permit referred to in paragraph 1 and 2 is free of charge.
  • 14 FINAL PROVISIONS

  2. Admit reserves the right to verify that the Competition Participants meet the conditions set out in the Regulations.
  3. The Admit company reserves the right to exclude from participation in the Competition Participants whose actions are contrary to the Regulations, with good morals, violate the legitimate interests of the Organizer or public persons, infringe the copyrights of third parties, harm the image of the Organizer or are against the law and are not suitable. for public distribution as they contain elements related to violence, discrimination, nudity, drugs, addiction and pornography.
  4. Participants awarded in the Competition, apart from the prize provided for in the Regulations, are not entitled to any additional remuneration apart from the Prize (including for the transfer of copyright to the Competition Application).
  5. The Admit company is not responsible for the inability to realize the prize for reasons attributable to the Competition Participant. Admit's liability is limited to awarding the prize in accordance with the provisions of the Regulations.
  6. The contest is in no way sponsored, endorsed, conducted or associated with Facebook and Instagram. Any content sent by Competition Participants in connection with the Competition should be addressed to Admit. Admit releases Facebook and Instagram from liability for damages arising in connection with conducting the Competition via the Admit Company Profile.
